1. The Defendants shall jointly and severally pay to the Plaintiff KRW 11,69,680 as well as the interest rate from February 23, 2017 to the date of full payment.
Reasons
1. Evidence 【Evidence” 1, A2, A3, A4-1, 2, A5-1 through 6, A6-1 through 3, A7-1 through 3, A7-3, A8, and the purport of the whole pleadings;
A. On March 28, 2016, the Plaintiff entered into a lease agreement with the Defendants on the attached list (hereinafter “instant building”) with the term of lease from May 1, 2016 to April 30, 2018 (24 months), deposit money of KRW 30 million, monthly rent of KRW 250,000 (value-added tax, monthly rent of KRW 1,000), and agreed to pay KRW 2 million on the date of the contract, and KRW 8 million on May 1, 2016, and the remainder of KRW 20 million on August 1, 2016.
On the other hand, the Plaintiff agreed that the rent shall be deferred until June 30, 2016, taking into account the period of interior works of the Defendants, and the monthly management fee shall be borne by the lessee from March 29, 2016, following the date following the conclusion of the contract.
B. (1) The Defendants were handed over the instant building from the Plaintiff on March 29, 2016, immediately after the conclusion of the instant lease agreement, but only paid KRW 10 million out of the deposit of KRW 30 million and did not pay the remainder of KRW 20 million, as well as from May 1, 2016 to June 30, 2016 (2 months from May 1, 2016).
(2) On September 2, 2016, the Plaintiff expressed his/her intent to terminate the lease on the grounds of the Defendants’ nonperformance by content-certified mail.
(3) On December 31, 2016, the Defendants delivered the instant building to the Plaintiff.
C. The Defendants’ unpaid rent is KRW 16,500,000 (=2,750,000 x 6) in total for six months from July 1, 2016 to December 31, 2016, and the unpaid management fee is KRW 5,19,680 (=4,714,840 +84,840) in total from March 29, 2016 to December 31, 2016.
The plaintiff deducted the unpaid rent and management fee from the defendant's lease deposit.
2. According to the above facts of recognition, the defendants are jointly and severally liable to the plaintiff 11,69.
