A defendant shall be punished by imprisonment for not more than ten months.

1. 공무집행방해 피고인은 2016. 7. 8. 02:05경 창원시 진해구 B아파트 104동 3-4라인 1층 입구에서, 폭행 관련 112신고 지령을 받고 현장에 출동한 진해경찰서 OO파출소 소속 경찰관인 경위 C이 피고인에게 사건 경위에 관하여 물어보자, 경위 C에게 “씨발새끼야 뭐꼬”라고 욕설을 하면서 주먹으로 경위 C의 입술 부위를 1회 때렸다.

Accordingly, the defendant assaulted police officers and interfered with legitimate execution of duties concerning the handling of 112 reported cases by police officers.

2. The Defendant was arrested as a flagrant offender under suspicion of obstruction of the performance of official duties at the time and place specified in paragraph (1), and was transferred to the Jinhae Police Station PO box located in Jinhae-gu, Changwon-si around 02:10 on the same day.

피고인은 그 무렵 위 파출소에서 대기하던 중, 친구 E 등이 있는 가운데 그곳 파출소 소속 경찰관인 피해자 F, 피해자 G에게 “씨발 개새끼, 짜바리 개새끼, 다 죽여버린다, 너거가 경찰관이가, 야이 씨발 자슥들아, 칼로 배떼지를 갈라 뿐다 개자슥아, 나이쳐먹고 그것밖에 계급 못 달았나”라고 욕설을 하였다.
