Reasons
Punishment of the crime
[Criminal Power] On July 10, 2020, the Defendant was sentenced to six months of imprisonment with prison labor for a violation of the Act on the Control of Narcotics, etc. at Seoul Southern District Court on July 10, 202, and the above judgment became final and conclusive on August 26, 2020.
【Criminal Facts】
Even if the Defendant is not a person handling narcotics, the Defendant dealt with the psychotropic drugs-related Meblopon (one philopon; hereinafter “philopon”) as follows:
1. Receipt of Handphones;
A. On October 2019, the Defendant received approximately 0.05g of philophones contained in D from B apartment C in Michuhol-gu Incheon, Michuhol-gu, Incheon, for a single-use c, and received philophones.
B. At around 14:00 on February 26, 2020, the Defendant received approximately 0.1g of philophones contained in G from G in a single-use injection machine in Michuhol-gu Incheon, Michuhol-gu.
2. Medication of phiphones.
A. At around 23:00 on February 24, 2020, the Defendant administered phiphones by inserting approximately 0.05g phiphones from the second floor of detached houses in the Michuhol-gu Incheon International Market to a single-use injection machine, dilution of water, and injection into the arms.
B. Around 14:00 on February 26, 2020, the Defendant administered phiphones in a way of inserting approximately 0.05 gopon into a single-use injection machine and dilution them into arms, which was parked near the F located in Michuhol-gu Incheon Metropolitan City E.
C. Around 15:00 on February 26, 2020, the Defendant, who was parked near F in Michuhol-gu Incheon, Seo-gu, Incheon, administered 0.05 grams in the way of inserting approximately 0.05 gopon into a single-use injection machine, dilution with water and injection into arms.
