A defendant shall be punished by imprisonment with prison labor for not more than ten months.

Punishment of the crime

[2] On January 29, 2015, the Defendant was sentenced to six months of imprisonment due to a violation of road traffic law (drinking) at the Sungnam support center, which was established on August 28, 2015, and the execution of the sentence is terminated. On April 20, 2017, the Defendant was sentenced to six months of imprisonment with prison labor, four months of imprisonment with prison labor, and two years of suspended execution and decided on April 28, 2017. On December 1, 2016, the same court was sentenced to six months of imprisonment with prison labor and one year of suspended execution and decided on July 18, 2017.

[Criminal facts]

1. On November 23, 2016, the Defendant was driving BMW 735LI car without obtaining a driver’s license from the 24th to the Seocho-gu Seoul Gangseo-gu, Gangseo-gu, Seoul, to the 62nd road.

2. On November 23, 2016, around 23:20 on November 23, 2016, the Defendant also tried to conceal the fact that he driven a BMW 735LI car without obtaining a driver’s license from around 24, 26:5,00 to around 62:0,000 Seocho-gu, Gangseo-gu, Seoul, Gangseo-gu, Gangseo-gu, Seoul, to a female-friendly C, who was on board the said car at the time of the instant case, operated the said car.

By speaking to ask investigative agencies to make statements, C made a false confession.

Therefore, on December 8, 2016, the Defendant made C false statement that C was driving as above, not the Defendant, at the traffic of the Seoul Gangnam Police Station and the D Team office, and made C sign and affix his seal on the statement protocol stating the aforementioned purport.

As a result, the defendant instigated the above C to escape a person who committed a crime corresponding to a fine or heavier punishment.
