A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

From June 28, 2012 to February 28, 2014, the Defendant served as an employee of the system operation team of a corporation with the 13th floor of the Guro-gu Seoul Metropolitan Government building C, and has been engaged in the business of computer resources management of the above company.

1. On January 1, 2014, the Defendant embezzled one server owned by D on the part of the victim (Seoul) who was in custody at the second floor of the SK brodiband IDC Center located in Seocho-gu Seoul, Seocho-gu, Seoul, for a commercial purpose, at the victim’s own custody (purchase price of KRW 1,500,000, market price of KRW 300,000). At that time, the Defendant arbitrarily occupied and disposed of at the above location at his own discretion and embezzled it.

2. Around January 2014, the Defendant, at the end of Seocho-gu Seoul Metropolitan Government Seocho-gu, embezzled the HP 146G HP Hadband (240,000 won at the market price) owned by the Victim Sea Secrets Co., Ltd., Ltd., which was in the custody of D on the second floor of the SK brodiband IDC Center, for the victim, while working for the victim. From the end of January 2014, the Defendant, at the second floor of the SK brodiband IDC center located in Seocho-gu Seoul Metropolitan Government, embezzled seven servers owned by the victims (purchase price of KRW 14,00,000, market price of KRW 2,100,000) on behalf of the victim, who had been in the business custody of the victim, at the second floor of the SK brodiandand IDC center, D, which was entrusted by D, at the second floor of the SK-gu Seoul Metropolitan Government, and embezzled by arbitrarily holding and disposing of it at the above location around that time.

4. On February 2014, the Defendant: (a) kept five CPU (11,320,100 won, market price 2,500,000 won, and 2,50,000 won, which is the ownership of the victim, Gangwon-do Lifelong Education Center, which was entrusted by D at the same place as the above paragraph (2) on his/her duty for the victim; and (b) embezzled by either arbitrarily holding it at the same place around that time.

5. On February 28, 2014, the Defendant was on the part of the victim corporation, the thirteenth floor of the Guro-gu Seoul building C, and was on the part of the victim, who was on the part of the victim, and was on the part of the victim, NT-P530 (Purchase Price of KRW 420,000) that was paid for business purposes.
