A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On August 11, 2017, the Defendant posted a false statement stating that “I will sell Igopical writing to Igopian Republic of Korea,” using a mobile phone from the 2017 Flusium,” and that “I will send Igopical writing to C who sent Igop if Igop KRW 200,000 to Igopian.”

However, the defendant did not have the above liability and did not have any intention or ability to send the above liability even if he received money from the injured party.

As such, the Defendant, by deceiving the victim, received KRW 200,00 from the victim to the Agricultural Cooperative (D) account under the name of the Defendant on the same day, and received KRW 4,906,000 from the time to January 12, 2018, by deceiving 24 victims in the same manner as indicated in the list of crimes in the attached Table of crimes, and transferred KRW 4,906,000 in total.

The Defendant, on October 9, 2017, posted a letter stating that “On October 29, 2018,” “On October 2018, 2018,” “On the bulletin board of the website’s “Serox ice GT Game” (see, e.g., evidence records 6, 9 pages) and then sent the remittance game machine to the victim E who visited the Defendant, with “104,000 won, including the cost of home-based distribution.”

However, even if the defendant did not have the above game machine and received the payment from the injured party, he did not have the intent or ability to send the above game machine to the injured party.

The Defendant, as such, by deceiving the victim, received 104,000 won from the victim, via the virtual account (Account Number: G) in the name of the Republic of Korea of the IMF from the victim.

On January 9, 2018, the Defendant posted a letter to the effect that “The 12-dong 110 and 110-dong H Apartment-si, Chungcheongnam-si, Chungcheongnam-si, and that “The sale of Ear and Aarb belt (the top)” is connected to the Korean car page of the NAV, using a mobile phone, and that “the victim reported and contacted shall be 60,000 won.”
