1. Basic facts

A. On December 4, 2009, the Defendant concluded a lease agreement with C and the attached list (hereinafter “instant building”) with a deposit of KRW 20 million, monthly rent of KRW 120,000 (excluding value-added tax; hereinafter the same shall apply), and with a lease agreement (a lease agreement referred to as “A evidence No. 3; hereinafter the same shall apply) with a maturity of January 10, 2010 to 24 months from January 10, 2010, the lessee was registered as D (the trade name E before the alteration; hereinafter the “D”).

On the bottom of the first lease contract, "Manager F" is indicated below the broker column.

B. On December 11, 2009, D completed the registration of incorporation by designating the representative director as the Defendant’s spouse G with the Defendant’s and in-house directors as the Defendant’s spouse G. On December 1, 2015, D was deemed to have been dissolved on December 1, 2015, and was concluded on December 3, 2018.

C. On March 6, 2012, H Co., Ltd. (hereinafter “H”) completed the registration of incorporation of G as its representative director on March 6, 2012. Around 2012, C, I and the second floor of the instant building: (a) drafted a lease agreement around October 1, 2012, whereby deposit amounting to KRW 20 million; (b) monthly renting KRW 120 million; and (c) delivery date.

D around January 1, 2016, around C, I and the second floor of the instant building were made up a lease contract with a deposit of KRW 20 million, KRW 1.2 million per month, and the delivery date on January 1, 2016.

E. On November 1, 2017, the Defendant drafted a lease agreement (No. 4 and 10, hereinafter “No. 2 lease agreement”) with a deposit of KRW 20 million on the second floor of the instant building, a monthly rent of KRW 1.2 million (excluding value-added tax), and a lease agreement (No. 4 and 10, hereinafter “No. 2 lease agreement”).

The back of the second lease contract includes "for business registration change".

On December 7, 2017, the defendant registered the second floor of the instant building as the place of business with the trade name JJ.

F. On March 22, 2018, the Plaintiff purchased the instant building from C and I, and completed the registration of ownership transfer on April 13, 2018.

G. The Plaintiff is the Defendant on June 21, 2018 and July 18, 2018, and December 7, 2018.
