1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Whether a subsequent objection is lawful or not. Article 470(1) of the Civil Procedure Act provides that "An objection may be filed within two weeks from the date on which the debtor was served with the payment order." Article 173(1) provides that "if the party concerned is unable to comply with the peremptory period due to any cause not attributable to him/her, he/she may supplement the procedural acts which have been negligent within two weeks from the date on which such cause ceases to exist." Thus, where the debtor is unable to comply with such period due to any cause not attributable to him/her, he/she may make a subsequent objection within two weeks from the date on which such cause ceases to exist." In addition, "reasons not attributable to the party" in this context refers to the grounds on which the party concerned could not comply with the period, notwithstanding his/her due care to do such procedural acts, after examining the case of this case, the court's significant facts and the purport of pleading as a whole, and the public official belonging to the court of Gyeyang-gu and the public official of Gyeyang-gu who directly received the plaintiff's request for the payment order from the defendant 13.
3. Therefore, even if the plaintiff's interests conflict with the defendant in the instant case received the original of the payment order directly, the defendant did not notify the defendant of such circumstances, so the original of the payment order was served.
