Reasons
Punishment of the crime
The defendants are people who open a cell phone, Internet, etc. through E, F, etc. or who throw away water purifiers, etc. in their own name in order to prepare a sudden hydrant.
1. Defendant A, in collusion with E in a state of weak mental and physical disorder,
A. Around November 7, 2014, at a mobile phone sales store located in 679, EXE information and communication mobile phone sales store located in Gyeyang-gu, Incheon. Around November 7, 2014, one mobile phone unit (G) was opened in the name of the Defendant, under the name of the Defendant, inasmuch as he/she would normally pay the mobile phone price or the mobile phone usage fee to his/her employees.
However, the Defendant had no intention or ability to pay the price of the device or the mobile phone normally because the Defendant requested the above E to extend a short-term loan via the “ported tin.”
The Defendant, by deceiving the staff of the mobile phone sales store, received one phiphone6 flus from the Victim LG Plus Co., Ltd., and received money from the said E, and the said E acquired property profits equivalent to the sum of KRW 1,93,070, by selling the said device to the mid-to-face mobile phone sales business entity and using the mind.
In collusion with the above E, the Defendant, from November 7, 2014 to November 25, 2011 of the same year, by deceiving employees of mobile phone stores, etc. on 14 occasions as shown in attached Table 1, and by using mobile phone terminals, etc. from the victims such as the radio operator, etc., and acquired a total of 16,095,516 won property interest.
B. On November 21, 2014, the Defendant, in collusion with E, paid a normal siren fee for the agreed period by using the H building and the Coweg website of the Nam-gu Incheon Metropolitan City around November 21, 2014. As such, the Defendant’s water purifier (a model name: CHPC-330N), air conditioners (a model name: APT-1014E), and sales lease (cMK-S01) in the name of the Defendant as if the agreed period expires.
