The action for retrial shall be dismissed.

The litigation costs for retrial shall be borne by the plaintiff for retrial.

According to the records, the plaintiff (the plaintiff) repeatedly filed a lawsuit for retrial, which was dismissed or rejected by the Supreme Court, and thus, the plaintiff filed a lawsuit for retrial to the same purport. Thus, such lawsuit for retrial is unlawful as it constitutes an abuse of the right of lawsuit.

Therefore, the retrial suit of this case is dismissed, and the costs of the retrial are assessed against the losing party. It is so decided as per Disposition by the assent of all participating Justices on the bench.
