A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Death or Injury caused by Dangerous Driving) is a person engaging in driving a B rocketing car;

On July 5, 2014, at around 18:00, the Defendant driven the said car with a blood alcohol concentration of 0.162%, and changed the course to three-lanes while driving the two-lanes in front of the Yellow Sea Gas Station distance, which is located at the end of the end of the Yecheon-si, Seocheon-si, Seocheon-si, into about 20km in the direction of Kimpo-si.

In this case, a person engaged in driving service has a duty of care to prevent traffic accidents by accurately operating the steering direction and brake system.

Nevertheless, the Defendant neglected this and failed to properly operate the steering system under the influence of alcohol, thereby leading the victim C(the age of 43) who was stopped to wait for the three-lane signal of the above road, followed by the left side of the Diver car driven by the victim C(the age of 43) and received the part of the stringer in front of the right side of the rocketing car.

As a result, the Defendant driven the above low-speed car in a situation where it is difficult to drive the car regularly due to influence of drinking, and suffered injury to the victim E (V, 43 years old) by driving the car for about two weeks, such as salt and tension, which requires a two-day medical treatment, and suffered injury to the victim E (V, 43 years old) who was boarding the car for the above low-speed car.

2. A violation of the Road Traffic Act (driving) was driven by the Defendant under the influence of alcohol with a blood alcohol concentration of about 0.162% at the section of approximately 8km from the roads in front of the Yellow Sea Oil Station located in the 8km-gu, Nowon-gu, Seocheon-si, Seocheon-si, Seocheon-si, to the roads in front of the flown oil station distance of about 8km-gu.
