Defendants shall be punished by imprisonment for one year.

Defendant

A as a representative of Ulsan-gu F apartment 203 Dong-dong, Ulsan-gu, 203, a qualification evaluation appraiser in relation to the selection of a construction company replacing the above apartment parts. The above F apartment was selected as a replacement company of the elevator parts of KRW 317,90,000 for the construction cost around February 2, 2017.

1. Defendant A

A. On July 15, 2016, the Defendant received an illegal solicitation from “J” restaurant located in Ulsan-gu Seoul Metropolitan Government I to the effect that “F apartment complex is selected as a replacement contractor for elevator parts.” On or around July 15, 2016, the Defendant was transferred KRW 5 million to the Agricultural Cooperative Account (K) in the name of the Defendant, and was remitted KRW 10 million to the same account on or around August 5, 2016.

As a result, the Defendant, who is in charge of the selection of the construction company replacing the part of the F apartment building and related affairs, acquired the benefit of 15 million won in return for the illegal solicitation from B.

B.
