Reasons
Punishment of the crime
[criminal record] On December 15, 2016, Defendant B was sentenced to a suspended sentence of two years for a violation of the Medical Service Act at the Seoul Central District Court on October 10 and the judgment became final and conclusive on December 23, 2016.
[Criminal facts] Defendant B is a unemployed of “I” located in Jongno-gu Seoul Metropolitan Government H, and Defendant A is a person who works as an employee of the said marina business establishment.
1. No person who is allowed to engage in massage activities for profit without obtaining certification of qualification as a massage club;
Nevertheless, from June 2016 to October 12, 2016, Defendant 1, along with B, etc., the main business of the above marina business establishment, employed women J and K, etc., who were not qualified as a massage club, as a marina branch, and Defendant 2, while managing the above business establishment, instructed many unspecified customers visiting the above business establishment at a studio, with a certain fee, and let the above women know the customers.
Accordingly, the defendant, in collusion with the above women in Thailand B, did not obtain recognition of the qualifications of the massageian, and performed massage for profit.

Defendant B, from June 2016 to October 2016, operated the said marina business from the said “I” to the said “I, and employed a female J, K, etc., who was not qualified as a massage club, and had the said female female in the said service engage in massage for profit-making purposes, such as having the said female in the said service provide massage services to an unspecified number of customers.
On June 6, 2016, the Defendant met C at a nearby French shop in Gangnam-gu, Gangnam-gu, Seoul through L around the beginning of June, 2016, and lent to the above C the name necessary to establish a marina corporation and to operate a marina shop, one million won per month.
