The defendant shall be innocent.
Reasons
1. On September 10, 2014, the Defendant: (a) at the D office in charge of the Defendant’s operation of the Defendant located in the Gu-U.S. Si around September 10, 2014; (b) as the introduction of the Gu-U.S. E, the victim G who is interested in the operation of the restaurant located in the Gu-U.S. F. However, the Defendant did not have any status or authority to participate in the operation of the above restaurant. Rather, even if the Defendant received money from the victim, the Defendant intended to use the money for other purposes, such as repayment of personal debts, and thus, the Defendant did not have the intent or ability to allow the victim
Ultimately, on September 17, 2014, the Defendant: (a) by deceiving the victim as above; (b) obtained the total of KRW 20 million from the Daegu Bank account (I) in the above name; (c) KRW 30 million around October 18 of the same month; (d) KRW 30 million around October 1 of the same year; and (e) obtained the transfer of KRW 20 million around the same month from the victim to the victim; and (e) obtained the transfer of KRW 100 million from the second day of the same month.
2. In light of the following circumstances duly adopted and examined evidence by this court, the Defendant did not have the intent or ability to allow the victim to operate the restaurant at the time when the Defendant received a total of KRW 100 million from the injured party.
It is insufficient to recognize it.
A. Whether a cafeteria was capable of operating the cafeteria, H (hereinafter “H”) decided to sell approximately approximately 37,000 of J and two parcels (including F, the site of the instant cafeteria) through D Co., Ltd. (hereinafter “C”) and received information from the final contractor via the Defendant.
