1. The instant claim against the Defendants by the Intervenor A, B, and C, both of the Plaintiff and the Defendants.
Reasons
1. Basic facts
A. From the end of 193, S, around the end of 1993, intended to purchase the instant land in KRW 240,00,00,00, and paid KRW 409,000 (T ownership, P land ownership, hereinafter the same) prior to the Pussisisisisisisisisisisisisisisisisisisisisisisisisisisisisisisisisisisisisisisisisisisisisisi (hereinafter the Plaintiff, B C’s ownership, Q land, and RR land) to newly construct multi-household housing and sell it on the ground (hereinafter the “instant land, etc.”) from the seller of the instant land, etc., by purchasing the instant land, etc. in KRW 240,00,00,00 from the seller of the instant land, etc., and by obtaining a construction permit from S, KRW 20,000,00,000 shall be paid for the remainder of the instant housing (hereinafter the “multihousehold”) and multihousehold housing”).
The representative of the seller of the land, etc. in this case refers to "A" and "B" who is a constructor.
1. If, without any condition, not less than 3 months (90 days) without permission in this construction work, Eul transfers all the particulars of the construction to Gap without any condition.
2. The value of land shall be 240,000,000 won, and 20,000,000 won shall be paid to Party A for construction permission.
3. Upon completion, upon completion of construction, A shall transfer the land to B at the time of completion and at the same time transfer two units of multi-family housing (second floor above the ground) to B to B.
4. B shall, after completion, pay in advance 100,000,000 won from part of the amount of application for bank loans to A.
5.3.4 For the purpose of paragraph 4, in the case of the non-performance of the transfer of land to Eul, as applicable mutatis mutandis, Eul shall transfer to Eul part of the property under the credit guarantee insurance policy or the name of Eul (not less than 200 million won) which is not less than 20 million won, after conducting a notarized treatment to Gap, all of its land.
B. S is granted a construction permit on July 11, 1994, and this case.
