A defendant shall be punished by imprisonment for one year.

The defendants, who are applicants for compensation, shall pay KRW 1,456,90 to C, and KRW 2,278,00 to D.

Punishment of the crime

From March 2013, the Defendant: (a) had been engaged in solicitation of so-called “the president,” where the name of the total book for telephone financial fraud is unknown; and (b) had been engaged in telephone financial fraud with 200,000 won per day as well as with telephone financial fraud assistance staff, such as the solicitation of the passbook (the name of a third party by stealing or borrowing the name of a third party and the actual user and the nominal owner of the passbook are different); (c) had been engaged in telephone financial fraud; and (d) had been engaged in the duties of “the head of the office,” and had been 20,000 won per day from the position of “the director,” and had been engaged in several banks in accordance with the direction of the above “the president,” either directly or through three other cash withdrawal books, E, etc. employed by the Defendant, to deliver immediately deposited money to the “president, etc.” by withdrawing it in cash.

The president, “the president,” where his/her name, which is the total book book for the fraud of the sales of merchandise coupons, is unknown, has written false comments with other telephone financial fraud investigators, and around March 2013, he/she opened a website on the Internet and sold merchandise coupons at a low price from around April 15, 2013 to “I will sell merchandise coupons of KRW 100,000 in lot department stores at KRW 90,00,000,” and then, he/she received KRW 4,279,500 from the victim G to the bank account (I) in the name of H offered through the large passbook solicitation book on April 15, 2013.

Afterward, the Defendant, as he recruited in advance, instructed the said “president” to immediately withdraw the said money from the bank near the said “president” through the Makwikset Service Delivery Board, who was waiting for the said “President” to directly withdraw cash, and then withdrawn KRW 4,460,00,00 with other money from the Kwikset Bank’s Credit Center located on the eight-lane-ro Seoul Metropolitan Government International Finance, around 12:22 on the same day.
