1. The Defendant’s KRW 77,468,020 as well as 5% per annum from September 16, 2017 to December 12, 2018 to the Plaintiff.
Reasons
Facts of recognition
1) The Plaintiff is a company that operates a special electric cable manufacturing factory located in S in Ssung City. The Defendant is a ground D plant in Ssung City (hereinafter “instant factory”).
(2) The instant plant was composed of three units from the left side of the front side of Dong, Dong, and Dong, as indicated in the separate sheet prior to the occurrence of the fire. However, at the left side of the instant plant, the building of two floors above C-ground steel structure (hereinafter “Plaintiffs building of this case”) owned by the Plaintiff was adjacent to the Plaintiff’s building of two floors above C-ground steel structure (hereinafter “the instant building”).
On September 16, 2017, around 02:10, when a fire occurred in the factory of this case (hereinafter “instant fire”), the entire parts of the instant factory A, B, and C, were destroyed by fire, and the parts of the instant building and its inner devices, inventory assets, and household fixtures were destroyed by fire.
Research on the fire site of this case
A. (1) From the outside of the factory, from the direction of the factory, the entire entrance part of the wall A, which is disseminated in the direction of the building A Dong and Cdong direction, is observed in terms of its original form, and the inside part is to be observed in the condition of the entire entrance part of the wall A, and the inside part of the part of the wall 1st floor is to be observed in the form of the wall and the inner collecting device, and the fire shape of the wall spreaded in the direction of the building B Dong is to be observed in the surface of the wall 3rd in the surface of the part of the wall 1st floor. In the inside part of the wall of the part of the wall 1st floor, the shape attached thereto is also observed in the second floor, and the inside part of the meeting room and office are to be observed in some form of fire, and outside stairs connected to A Dong and B Dong are located in the outside part of the building 2nd floor located in the building 4th floor, and the wall collapse between the building and the inner part are to be observed in the wall.
