Reasons
1. Basic facts
A. In accordance with the former Act on Temporary Measures for the Improvement of Residential Environment for Low-Income Urban Residents (amended by Act No. 6656, Feb. 4, 2002; hereinafter “Temporary Measures Act”), the Gunsan-si designated the D Day as an urban and residential environment improvement district (hereinafter “instant project”), and designated the Korea National Housing Corporation (hereinafter “Defendant”) as a co-implementer of the instant project, on May 1, 2002, by designating the Gunsan-si as an urban and residential environment improvement district (hereinafter “instant project”).
B. Around July 2002, the Defendant obtained approval from the Governor of Jeollabuk-do to construct six public rental apartment units and 318 households (hereinafter “instant apartment units”) in accordance with Article 33 of the former Housing Construction Promotion Act (amended by Act No. 6732, Aug. 26, 2002) in the instant project district and publicly lease them.
C. C. The defendant completed the apartment of this case around March 2006 and completed it around that time.
(f) The remaining designated persons, except the designated persons mentioned in paragraph (1), and (f) leased each of the instant apartment units to the buyers mentioned in paragraph (5) for five years.
The Defendant, when five years have elapsed since the mandatory rental period of the instant apartment, went to the date of conversion for sale in lots, was between October 1, 201 and December 26, 201.
