A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

The defendant and the victim B are all foreigners of Vietnamese nationality.

1. Around December 27, 2018, the Defendant made a false statement that “I would create a visa to enable Vietnam women to enter and live in Korea. I would like to create a visa within three months if you send KRW 1,100,000 per capita to 1,10,000.”

However, even if the defendant receives money from the victim, he did not have the intention or ability to create the victim.

Nevertheless, the Defendant, by deceiving the victim as above, received KRW 1,100,000 from the victim to the C account under the name of the Defendant on the same day, and acquired a total of KRW 7,700,000 from around that time to June 15, 2019, as shown in the crime sight table (section 5).

2. Around July 12, 2019, the Defendant made a false statement to the effect that “The Defendant would make a payment three days after the lending of money to the victim,” by phoneing the victim at a closed area of not more than Incheon, Incheon.

However, even if the defendant borrowed money from the victim, the defendant did not have the intent or ability to pay to the victim.

Nevertheless, the Defendant, by deceiving the victim as above, received KRW 2,500,000 from the victim’s account under the name of the Defendant on the same day, and received KRW 60,000 from the Vietnam account designated by the Defendant, and acquired KRW 5,540,00 in total by receiving KRW 60,00 from the Vietnam account ( KRW 3,040,00 in total).

around January 7, 2019, the Defendant: (a) entered Korea with approximately one million won per person, even though he/she received money from the victim for the purpose of job placement assistance, etc. from the victim, even though he/she did not have an intention or ability to enable the victim’s family members or other persons to normally enter Korea and work in Korea.
