1. It is confirmed that there is no lien on the real estate listed in the attached Form No. 2 of Defendant B;
2. Defendant C.
Reasons
1. Basic facts
A. D had obtained a building permit on December 24, 2003, and started the construction work of the same structure on the land of 616.2 square meters in Busan Metropolitan City, E-gun, Busan Metropolitan City.
B. Around August 10, 2004, Defendant B was awarded a contract for the creative construction work from D among new construction works.
C. A project owner was changed on November 24, 2004 due to D's default, and on May 22, 2007, the KF, G, H, and I changed to J.
Defendant B, on June 18, 2007, prepared a written confirmation of payment for the construction cost of KRW 50 million from K, which is an agent of the KF, and received a favorable judgment on September 23, 2011, when Defendant B filed a lawsuit for construction cost payment against the Busan District Court-dong Branch of the Busan District Court 201Kadan8388 and proceeded with the KF by public notice.
E. D In relation to a building which has ceased construction due to bankruptcy as Busan District Court Branch Branch 2008Gahap3083, the building located adjacent to the Mtel, including the real estate in the attached Form (hereinafter “instant officetel”), is Ntel.
On September 30, 2010, 33 households filed a lawsuit, such as cancellation of registration of preservation of ownership, and received a favorable judgment.
F. Registration of ownership transfer was completed on February 19, 2013 with respect to the instant officetel as its owner, and registration of ownership transfer was completed on October 30 of the same year on December 17, 2013 with respect to the instant officetel as of December 19, 2013.
G. On August 17, 2015, the Plaintiff purchased the instant officetel and acquired ownership in the real estate auction procedure for the Dong Branch of Busan District Court P&D.
H. On December 5, 2014, Defendant B leased the instant officetel to Defendant C, and the Defendant C occupied and used the instant officetel from that business day.
I. The amount equivalent to the monthly rent of the instant officetel is KRW 200,000 per month.
