A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The Defendant is a person sharing a Do86m2 (hereinafter referred to as “C”) in E and 1/2 shares in Gyeonggi-gu C forest land (hereinafter referred to as “C”).
Upon F’s request, the Defendant: (a) borrowed KRW 28.4 million from the instant non-party G to divide it into F and divided it; (b) as a result, the Defendant had been urged to repay the borrowed money from G to G; (c) in turn, the Defendant had been willinged to obtain a loan by raising the land price by dividing the instant non-party E-owned land into “H prior to division” and changing the land category; (d) the Defendant was a co-owned share holder of C; and (e) the owner of H prior to division was anticipated to have been unable to obtain permission from E without obtaining permission from F and without obtaining permission from E, with intent to arbitrarily divide the said land and change the land category.

On January 31, 2012, the Defendant, along with F, divided “B prior to the division” into “590 square meters prior to the Gyeonggi-gun H and “392 square meters prior to the Gyeonggi-gun J.,” and marked “C” into “1,687 square meters prior to the Gyeonggi-gun, Gyeonggi-do,” and ordered F to read “C”, “311 square meters prior to the Gyeonggi-gun, Gyeonggi-do, L, and 658 square meters prior to the division.” The Defendant: (a) notified I of the resident registration number of E and N; (b) notified the Defendant and F, with the consent of E and N; and (c) marked I as the applicant for the division of land and the application for registration conversion; and (d) sealed B’s name and registration number in advance; and (c) sealed B’s resident registration number and registration number; and (d) sealed B’s name and registration number in advance.
Accordingly, the Defendant, in collusion with F, forged a written application for partition of land (forest) in the name of E, a private document on rights and obligations, and one copy of a written application for modification of registration.
2. The Defendant, together with F, forged I at the time and place specified in the preceding paragraph.
