Reasons
Punishment of the crime
1. Defendant A
A. A. The Defendant is an abandoned employee in Hno-Ma in the Hancheon-gu G underground of the Hancheon-gu, the Defendant is the victim I ( South and 45 years of age) who was the said singman.
On August 5, 2014, from around 21:00 to around 22:00, the Defendant sold drinking and scambling to the victim in the instant singing room 5. From around 21:0, the Defendant discovered that the victim, under the influence of alcohol, was able to see the scams on the clothes in the state of drinking, and was locked.
In such a case, the Defendant sold alcoholic beverages to consumers, and the business operator providing services, even though he/she had the legal and contractual duty to take measures necessary to prevent harm to the life and body of consumers, was in the state of the victim’s defense, and did not take necessary measures, such as allowing the victims to continue to sing in the singing room or communicating with the persons in the singing room or the police station. On August 6, 2014, he/she moved the victims to the singing room with C at around 03:00 on August 6, 2014. After closing his/her business after one hour in the singing room, he/she abandoned the victims in need of aid by taking care of the fact that he/she provided alcoholic beverages in the singing room.
B. On August 5, 2014, the Defendant violated the Music Industry Promotion Act: (a) from around 21:00 to around 22:00 on August 5, 2014, the Defendant: (b) from around 21:00 to around 22:00 on the same day, sold 2 bottles and 1 cans to customers in the instant singing room in KRW 16,000; (c) around 22:30 on the same day, the Defendant sold 1 cans to customers under his/her name and in the instant singing room in KRW 8,00; and (d) sold 1 cans to customers under his/her name and in the same month.
6. At approximately 00:40, at approximately 6,00, two cans for beer to customers with no name, and at approximately 6,000 won per hour to beer C and J, and C and J enter the above singing room two, five, and six.
