1. 38,272,00 won out of 43,056,00 won deposited by the Defendant at the Daejeon District Court on April 23, 2018 as gold No. 2461 in the year 2018, and the year 2018.

1. Basic facts

A. The parties’ relevant Nonparty C (hereinafter “the deceased”) are those holding 1/6 shares of each of the land D, E, and F (hereinafter “instant land”) in sequence, Seo-gu, Daejeon, Daejeon (hereinafter “instant land”).

On March 28, 2018, the Defendant: (a) deposited KRW 43,056,00 as compensation for the deceased’s share out of the instant land No. 1 in the Daejeon District Court on April 23, 2018, as KRW 2461, KRW 3,323,830, and KRW 678,330 as compensation for the deceased’s share out of the instant land No. 2 in the form of money No. 2463 under the Act on the Acquisition of Land, etc. for Public Works and the Compensation therefor, on the ground that the whereabouts of the landowner cannot be known through the adjudication of expropriation by the Daejeon Metropolitan City Land Expropriation Committee on each of the instant land; and (b) on the ground that the whereabouts of the landowner cannot be known; (c) on April 23, 2018, the Daejeon District Court deposited KRW 2461 as compensation for the deceased’s share among the instant land No. 3 in the form of money No. 2, 2018.

(hereinafter referred to as “the deposits of this case 1 through 3” in succession, and the deposit of this case in combination is referred to as “each deposit of this case”). (b)

The deceased’s inheritance relation 1) The deceased was born on January 21, 1917 and died on February 22, 1984 without his/her lineal descendant and spouse on his/her death on February 22, 1984 and transferred his/her share of H, I (n, marriage on April 18, 1929), and J shall inherit 4/9, 1/9, 4/9, 4/9, respectively. Since H died on October 5, 1959, H’s share of inheritance was inherited by inheritance by inheritance of H’s spouse K, children L, and L, who died on August 20, 194 on the deceased’s death by inheritance of H solely. Meanwhile, J donated his/her share of inheritance to L on August 18, 198, and acquired the Plaintiff’s share of inheritance, inheritance by inheritance of his/her spouse, inheritance by inheritance of his/her spouse, and inheritance of the deceased’s share of the deceased, the Plaintiff’s share of the deceased’s share of inheritance.
