The defendant shall be innocent.

The Constitutional Court Decision 2008Hun-Ga17 Decided July 30, 2009 ruled that "if an agent, employee or other employee of a corporation commits a violation under Article 83 (1) 2 in connection with the corporation's business, under Article 83 (2) 2 of the former Road Act (wholly amended by Act No. 7832 of Dec. 30, 2005) which is the applicable provisions of the prosecution of this case against the defendant, the court shall impose a fine on the corporation concerned" in Article 86 of the former Road Act (wholly amended by Act No. 8976 of Mar. 21, 2008) that "if the agent, employee or other employee of the corporation commits a violation under Article 83 (1) 2 of the Act with respect to the corporation's business, the corporation shall also be punished by a fine."
