1. All of the plaintiffs' claims are dismissed.

Basic Facts

The Defendant is the principal contractor who entered into a business agreement with E around July 201, and accordingly received a contract for construction of the Ftel (hereinafter “instant building”) from E (hereinafter “instant construction”). The Plaintiffs are the subcontractors who completed the instant construction work upon receiving a subcontract from the Defendant from October 2013 to July 2014.

Plaintiff 1A (G) 24,957,600 Won 2 B (H) CATV, electric relay broadcasting, main loan delivery work 21,200,000 Won 3C (I) Cable Distribution System 42,148,909 Won 4D (J) Delivery System 22,386,542 Won 22,70,000 which was unpaid construction cost as stated in the claim of KRW 22,70,00,000, which was paid by Plaintiff D from the preparatory document dated August 10, 2016. The amount calculated by deducting KRW 313,458,00 which was paid by Plaintiff D from the above money. The Defendant did not dispute the settlement recommendation decision of this case on November 21, 2016, which was based on the foregoing money, with the purport that the Defendant did not directly pay debt settlement as follows, but did not dispute the amount of this case’s debt settlement.

5 The Plaintiff Kangjin Construction Co., Ltd. initially claimed KRW 120,504,100 for the unpaid construction cost, but did not raise any objection against the decision of this court to recommend settlement, reflecting the defect repair cost of KRW 9,903,00 as a result of appraisal.

The above decision of recommending reconciliation also became final and conclusive due to the lack of objection by the plaintiff corporation's Gangnam Construction and E, and the defendant did not dispute the amount, but did not bear the obligation due to direct payment, etc. as seen below.
