A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

1. Fraud against the victim C;

A. On January 1, 2015, the Defendant made a false statement to the effect that “The Defendant would sell the victim’s vehicle from F to F once a year” to the victim’s E office located at the Seocho-si, Jeju, 2015, that “The Defendant would purchase the low-speed vehicle with KRW 14.5 million up to April 2015 through the person in charge.”

However, in fact, the defendant merely thought that he would receive the purchase price from the victim and use it as living expenses, and the F would dispose of the used vehicle at the head office, so even if he would receive the purchase price from the victim, there was no intention or ability to purchase the lowestest typin sold from the victim with the F in good faith.

The Defendant, by deceiving the victim as above, received KRW 14.5 million from the victim’s account of community credit cooperatives (Account Number G) in the name of the Defendant, on or around February 24, 2015.

B. On April 2015, the Defendant made a false statement to the effect that “F would purchase the rocketing used vehicles sold by F with the intent to purchase KRW 13 million by December 2015, 2015.”

However, in fact, the defendant merely thought that he would receive the purchase price from the victim to use it as living expenses, etc., and the F would dispose of the heavy vehicle at the head office, so even if he received the purchase price from the victim, he did not have any intention or ability to purchase the rocketing heavy strawing vehicles sold from the victim at a low price.

The Defendant, as above, by deceiving the victim, received KRW 13 million from the victim to the account of the above community credit cooperative on May 6, 2015, as the purchase cost for vehicles.

2. On February 1, 2015, the Defendant against the victim H was at the J office located in Jeju City I, and there is a difference between the victim H to sell the “F at a price lower than the F market price.” From the person in charge, KRW 13.5 million to the police officer of April 2015.
