2. Determination as to the claim against Defendant A

가. 인정사실 (1) 원고는 2013. 11. 1. 피고 A에게 별지1 기재 건물(이하 ‘이 사건 건물’이라 한다) 중 별지2 도면표시 ㉠, ㉡, ㉢, ㉣, ㉠의 각 점을 순차로 연결한 선내 (가) 부분 사무실 6층 28.52㎡[이하 ‘이 사건 (가)부분’이라 한다]를 임대차보증금 5,500,000원, 임대료 월 550,000원, 관리비 월 250,000원 등 합계 800,000원(매월 말일 지급)(부가가치세 별도), 임대차 기간 2013. 11. 1.부터 2014. 10. 31.로 정하여 임대하였다

(2) Article 5 of the first lease contract of this case provides that the lessor may terminate the contract after giving a peremptory notice to the lessee with a grace period of at least seven days, if the lessee fails to pay the rent for at least five days from the due date.

(2) On December 21, 2013, Defendant A paid only KRW 1,760,000 out of KRW 1,760,000 among the total monthly rent and management fee for the month of November 201, and the total monthly rent and management fee for the December of 2013, Defendant A delayed payment of KRW 760,000,00.

Defendant A did not pay the total of KRW 4,400,00 (= KRW 880,000) monthly rent and management fee for five months from January 2014 to May 201, and the total of KRW 5,160,000 (= KRW 760,000) was overdue as of May 2014.

(3) Upon receiving the Plaintiff’s demand, Defendant A paid part of the rent, etc. in arrears from June 2014 to the Plaintiff, and as of January 25, 2015, Defendant A became a total of KRW 3,750,500 for the rent in arrears and management fee in arrears as of January 25, 2015. Accordingly, the Plaintiff notified Defendant A of the termination of the instant lease agreement on the ground of the overdue rent for at least two years by mail certified as of January 26, 2015.
