The plaintiff's claim is dismissed.

Litigation costs shall be borne by the plaintiff.

1. The Plaintiff’s refusal to pay the check amount of KRW 138,305,00 and delay damages to the Defendant, who is the issuer of the check number, as the check number of KRW 138,305,00 issued by the Defendant (the check number C, face value of KRW 138,305,00, and the check number of KRW 43,00) was presented on January 20, 202, and the payment was made on July 13, 2019.

2. The presentation for payment of a check shall be made within 10 days from the date of publication (Article 29(1) of the Check Act). Even if the Plaintiff’s assertion is based on the Plaintiff’s assertion, the presentation for payment was made after the date of presentation for payment, and the Plaintiff lost its right to demand reimbursement against the Defendant who is the drawer, and the evidence submitted by the Plaintiff alone is insufficient to deem that the Plaintiff may demand payment of the check to the Defendant

Therefore, the plaintiff's claim is rejected.

3. Therefore, the plaintiff's claim of this case is dismissed as it is without merit. It is so decided as per Disposition.
