1. The Defendants are jointly and severally and severally liable to the Plaintiff 102,771,844 won and 15% per annum from May 6, 2019 to May 31, 2019.
Reasons
1. Indication of claims: It shall be as shown in attached Form; and
2. Judgment without holding any pleadings (Articles 208 (3) 1 and 257 of the Civil Procedure Act);
3. According to the main sentence of Article 3(1) of the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings by Partial Dismissal (amended by Presidential Decree No. 29768, May 21, 2019), the statutory interest rate under the main sentence of Article 3(1) of the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings is 12% per annum from June 1, 2019, and thus, the part of the claim for damages for delay seeking payment exceeding 12% per annum from June 1, 2019 is rejected.
