All of the prosecutions of this case are dismissed.

1. Facts charged;

A. At around 14:00 on February 28, 2019, Defendant A resisted the victim B (the age of 39) at the 11st floor of the Gangnam-gu Seoul Metropolitan Government Mediation Corporation D office for the settlement of the merger disputes, which was divided into a contract issue, and was spited five times on the victim’s face.

B. Defendant B, at the time and place in the above paragraph (a) above, spits the victim’s face against the victim A (the age of 73) who assaults the Defendant, such as paragraph (a).

2. Determination

(a) Applicable provisions of Acts: Article 260 (1) of the Criminal Act;

(b) Crimes of non-compliance with will: Article 260 (3) of the Criminal Act.

C. On June 28, 2019, the date of prosecution, the date of the first trial on June 28, 2019, the victims expressed their intention not to be punished.

(d) Judgment dismissing public prosecution: Article 327 subparagraph 6 of the Criminal Procedure Act;
