Punishment of the crime

[Power of crime] On November 16, 2007, the Defendant issued a summary order of KRW 700,000 to a fine for a violation of road traffic law at the Daegu District Court.

[Criminal facts] On September 22, 2020, the Defendant driven E Lastren vehicles under the influence of alcohol concentration of about 0.101% from the 250-meter section from the front road located in Gyeonggi Fast Group B to D front roads.

As a result, the Defendant once driven a motor vehicle under the influence of alcohol despite the fact that the Defendant violated the prohibition of drinking.

1. Previous conviction: Application of an inquiry letter, such as criminal history, and an inquiry report (verification of criminal history of a suspect) statute;

1. The Defendant, on the grounds of sentencing of Article 334(1) of the Criminal Procedure Act, once driving alcohol again even though he/she had a record of driving alcohol, was driving alcohol again, and the alcohol concentration in blood was high at the time.

However, the area of drinking driving is short, and the driving power of drinking is ten years prior to that of drinking driving.

The punishment shall be determined as ordered in consideration of such circumstances and the defendant's age, character and conduct, environment, and circumstances after the crime.
