1. Details of the disposition;

A. The Plaintiff was established on February 1, 1984 for the purpose of manufacturing steel structures, wholesale of machinery and steel plates, etc. and had its head office, mining-1 factory (hereinafter “instant place of business”), luminous-2 factory, and brine factory.

B. From January 1, 2012, the Defendant classified the business type of the instant workplace as “business (industry code: 21814) of industrial accident compensation insurance premium rate and business type forecast table publicly notified by the Minister of Employment and Labor (hereinafter “business type forecast table”) and applied the industrial accident insurance premium rate for the instant workplace to 39/100.

C. On February 5, 2014, the Plaintiff issued a notice from the Defendant on January 1, 2014 to the effect that “business from time to time cutting and selling metal materials (or metal materials attached with a type of finished stuff) at the request of an unspecified customer” is changed in the category of business with the content classified as “doing retail and consumer product repair business (type of business: 9,001).” Accordingly, the business type of the instant place of business is likely to be changed from the “business of making an contact with or using various metals” to “doing retail and consumer product repair business. In such cases, submission of data necessary for the change of the type of business is attempted.”

Accordingly, on July 22, 2015, the Plaintiff submitted to the Defendant an industrial accident insurance report to the effect that the business type of the instant workplace changed from “business that provides various metals or repairs business,” to “the wholesale retail and consumer products repair business,” but the Defendant supplied the business type of the instant workplace in the form of continuous mass supply under a contract with an unspecified customer, not from the form of frequently cutting and selling, at the request of an unspecified customer, the business type of the instant workplace as its raw material, but from August 13, 2015.
