1. All of the plaintiff's claims are dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1.The following facts, such as the conclusion of a sales contract, are not disputed between the parties, or may be acknowledged in full view of the respective entries and arguments in Gap evidence Nos. 1, 2, and 4 (including each number; hereinafter the same shall apply) and the whole purport of the pleadings:
On January 5, 2014, the Plaintiff sold to Defendant B a reinforced concrete building (hereinafter “instant building”) of the size of 350,000,000,000 of the purchase price, which is 30,000,000,000 won of the down payment of KRW 30,000,000 among the down payment of KRW 30,00,000,000, the remainder payment of KRW 320,000 was paid on January 6, 2014, and the remainder of KRW 320,00,00,000 was paid on March 17, 2014.
B. According to the above sales contract, Defendant B paid the Plaintiff KRW 10,000,000 on January 5, 2014 as down payment, and KRW 20,000,000 on January 6, 2014, and KRW 30,000,000 on a total, as down payment.
C. On February 21, 2014, Defendant B proposed that Defendant C be added to the Plaintiff as a joint purchaser of the above sales contract. Upon the Plaintiff’s consent, the sales contract (hereinafter “instant sales contract”) signed again on January 5, 2014, which revised the purchaser to the Defendants, on which January 5, 2014 was revised.
Article 2 (Transfer, etc. of Ownership) The seller shall, at the same time, deliver all documents necessary for the registration of transfer of ownership to the buyer and cooperate with the registration procedure, and the delivery date of the said real estate shall be March 17, 2014.
Article 3 (Extinguishment of Restricted Real Rights, etc.) If any ground exists to restrict the exercise of ownership, such as mortgage, superficies, right of lease, etc. established on the above real estate, or there is any unpaid amount of taxes and other charges, the seller shall remove the defects, burdens, etc. of such rights and transfer full ownership to the buyer by the date
provided that such rights are agreed to succeed; and
