1.The judgment of the first instance, including a claim that has been changed in exchange in this Court, shall be changed as follows:
Reasons
1. Basic facts
A. The Plaintiff (Appointed Party)’s claim 1 against the Plaintiff (Appointed Party) and the Appointed Party Company B
hereinafter referred to as the plaintiff
(1) The Defendants 1 and 2 (hereinafter “Defendant 2”) and the Defendant Company B from January 2, 2012
B) As of May 22, 2013, to compensate for the amount of KRW 90,532,337 for the goods that the Plaintiff had not received as payment, the trade name was changed to the Daewoo bus Co., Ltd. (i.e., one-day treatment bus Co., Ltd. on August 13, 2013);
(b) the term "self-managed bus";
(2) On July 27, 2013, the order of payment was finalized on July 27, 2013 by the Busan District Court 2013Kadan6239, on the claim of KRW 90,532,337, among the claim for the purchase price of goods held against the Defendant, and the order of payment was issued on July 27, 2013 in order to receive KRW 16,610,00,00 from April 201 to June 2013, the designated company future industrial machinery, which was a part necessary for bus manufacturing, from the above court, filed an application for provisional seizure against the claim of KRW 90,532,337, among the claim for the purchase price of goods held by the Defendant. The order of payment order was finalized on July 9, 2013 by the above court.
3) In order to receive KRW 36,145,868 upon the supply of automobile parts to B following the supply of automobile parts to B, the Appointor D applied for a payment order under Changwon District Court Kim Jong-si, Kim Jong-si, 2013 tea 1953. The foregoing court’s order of payment order was finalized on July 18, 2013. 4) The Appointor C was determined on July 18, 2013 to preserve KRW 29,237,015, among the goods payment claims against B, KRW 29,237,015, among the goods payment claims against B, the amount of KRW 29,237,015, Busan District Court filed an application for provisional seizure of claims under the Busan District Court Decision 2013Ka6528, Jul. 9, 2013.
