A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

1. Fraud;

A. On December 26, 2012, the Defendant: (a) at the victim G’s residence located in Tong Young-si on December 26, 2012; (b) despite the fact that the Defendant was in a bad economic situation as described in the foregoing paragraph (a) and was issued by the victim with the gold Ban, etc. and repaid the borrowed money within one month, and did not have the intent or ability to return the borrowed money to the victim by receiving the refund of the gold Ban, etc.; (c) however, the Defendant would have borrowed the money from the victim, if he/she borrowed the gold Ban or gold boom, he/she would recover and return the gold Ban, etc. within one month after borrowing the money from the victim and using the money to the pawn; and (d) the Defendant received from the victim the sum of three KK 18 K 1,81,000 won at the market price at one million won at one hundred and one million won at one market price at one hundred and one hundred eight million won at one.

2. The Defendant embezzled, around March 201, there is no time to visit a community credit cooperative in order to withdraw cash, since the inside of the “he parent” from the victim G was gathered from E fishery operated by the Defendant in Tong Young-si D market operated by the Defendant in Tong Young-si.
