1. The Defendant’s KRW 202,752,00 for the Plaintiff and 6% per annum from August 31, 2019 to May 8, 2020, and the following.
Reasons
1. Basic facts
A. 1) The Defendant entered into a construction contract with the “Ull Military Public Notice B” around March 2012, which is a long-term continuing business (hereinafter “instant construction”).
(2) On March 23, 2012, the Plaintiff and the Defendant entered into the first number of contracts with respect to the instant construction works, setting the contract amount of KRW 4,223,212,650, and the construction period from March 30, 2012 to March 24, 2013. The terms and conditions of the contract include “8,510,256,630,” “total construction period of KRW 1,080,” “total construction period of KRW 1,080,” and “total construction date of completion of construction” respectively;
(3) The general conditions of the construction contract of a local government incorporated into the contents of the instant construction contract (amended by Ordinance of the Ministry of Public Administration and Security No. 333, Oct. 26, 2010; hereinafter “instant general conditions”) under the general conditions of the construction contract of a local government incorporated into the contents of the instant construction contract (amended by Ordinance of the Ministry of Public Administration and Security No. 3333, Oct. 26, 201).
B) Of the parts related to the instant case are as indicated in the general terms and conditions of the local government’s construction contract. (B) On May 31, 2016, the Plaintiff concluded a contract with the Defendant each year for the instant construction work. On May 31, 2016, the Plaintiff entered into the five primary contract with the Defendant for the contract amount of KRW 1,703,090,000, and the construction period from June 1, 2016 to October 23, 2017 (hereinafter “the five primary contract”).
2) The instant fifth water contract increased the contract amount to KRW 3,301,950,00 through a nine-time change contract as listed below, and the construction period was extended on November 20, 2018 by November 20, 2018 (hereinafter “the extension of the instant construction period”).
() The contract amount of the number of days extended as of the date of completion of construction (the first contract on the ground of change in 1,703,090 on October 23, 2017, the first contract on the ground of change in 1,703,090 on May 31, 2016, amended on November 7, 2016.
