Reasons
1. Basic facts
가. 일제강점기 하 작성된 토지조사부에 의하면, 1913. 4. 5.경 경성부 남부 H(京城府 南部 H)에 주소를 둔 I이 경기 파주군(행정구역 명칭이 1996. 3. 1. 파주시로 변경, 이하 ‘파주시’라 한다) J 전 1,931평(이 사건 분할전 J 토지), 파주시 K 토지(이 사건 분할전 K 토지)를 사정받은 것으로 기재되어 있다.
B. The Defendant Republic of Korea completed the registration of ownership preservation on October 13, 1995, No. 30700 on the land of this case, which was received on October 13, 1995.
The non-party L filed a lawsuit for cancellation of registration of ownership preservation, claiming that the land of this case 1 was divided into or changed from the N land in which L’s fleet M was assessed, and on January 8, 2009, “The Republic of Korea shall cancel the registration of ownership preservation as above with respect to the land of this case to L,” and the above judgment was finalized on January 31, 2009.
L according to the above judgment, the registration of ownership transfer was completed on February 16, 2009 with respect to the land of this case as the Goyang-gu District Court, Goyang-gu Office of the High District Court, the registration of ownership transfer was completed on October 19, 2016, and thereafter, on October 24, 2016, theO completed the registration of ownership transfer due to inheritance due to a consultation division as of March 24, 2016. Defendant D purchased the land of this case from O on November 9, 2016 and completed the registration of ownership transfer as of November 18, 2016.
C. On December 29, 1961, the change of ownership of the instant land No. 2 was divided into 47 square meters from the J land before the instant partition, and the instant land No. 2 was the land. At the time of the cadastral restoration, P was deleted from the owner column and entered as the owner’s unclaimed restoration.
Defendant Republic of Korea registered the preservation of ownership on July 1, 1993 by 8902, the registration office of the High Government Branch of the District Court of Dongyang Branch of the High Court on October 21, 2013.
