1. The defendant shall pay to the plaintiff KRW 70,000,000 as well as 12% per annum from June 16, 2020 to the day of full payment.

Comprehensively taking account of the overall purport of the statements and changes in Gap evidence Nos. 1, 2, and 3, it is recognized that the plaintiff made a letter of loan with the content of lending KRW 70 million to the defendant from March 23, 2018 to April 30, 202, and KRW 30 million on May 8, 2018. As to this, the plaintiff and the defendant made a letter of loan with the content of lending KRW 70 million to the defendant from March 23, 2018 to April 30, 2020.

Therefore, the Defendant is obligated to pay late payment damages calculated at the rate of 12% per annum from June 16, 2020, after serving the original copy of the instant payment order, with respect to KRW 70 million, which is equivalent to the Plaintiff, to the day of full payment (the Defendant submitted an objection against the Plaintiff’s payment order on June 26, 2020, and the above document does not state the purport of specifically disputing the Plaintiff’s claim, but did not submit any written reply and did not appear on the date of oral argument three times). Accordingly, the Plaintiff’s claim of this case is reasonable, and it is so decided as per Disposition with the assent of all participating Justices.
