The defendant shall be innocent.

1. Summary of the facts charged

A. Basic facts B is the business owner operating a sexual traffic business establishment with the trade name “D” in the three floors of Gwangju Mine-gu C building (hereinafter “the instant building”). The said business establishment is a business establishment registered in the Internet E-site shuttlener as “F” and is located in the Internet E-site shutdown, and is equipped with 22 marina rooms with a size of 515 square meters for unspecified male grandchildren, such as similar sexual intercourse, and three waiting rooms for female employees, one toilet, two shower rooms, and one kitchen room.

B. The Defendant was the owner of the instant building where the said “D” business place is located, and received notification from the head of the Gwangju Mine Police Station on March 10, 2016, stating that “H, a business place with the same place leased to G around March 4, 2014 and operated there was a crackdown on the suspicion of engaging in sexual traffic around March 10, 2016, and then, on April 11, 2016, the head of the Gwangju Mine Police Station may punish the owner of the instant building where the said “D” business place is located, and further cooperates with the said building to ensure that it does not provide sexual traffic.”

Nevertheless, on November 2, 2017, the Defendant entered into a lease agreement that collects KRW 310,000,000 per month from a person who intends to operate a marina business which is the same type of business without changing the structure of the instant building, and provided the said place even though he knows that the said business is acting as an intermediary for sexual traffic against an unspecified male grandchild, and received from B a total of KRW 31,00,000 per month from February 5, 2018.

2. The following circumstances revealed from the evidence duly adopted and investigated by this Court, namely, ① the Defendant was notified by the head of the Gwangju Mine Police Station around April 11, 2016 that the instant building was provided as a sexual traffic place; ② the head of the instant building from November 2, 2017 to the instant building.
