1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Details of the disposition;
A. On January 14, 1950, the Plaintiff’s attached B (CB, hereinafter “the deceased”) was discharged from active service under the Second Lieutenant on October 31, 1967. After discharged from active service, he was diagnosed on December 3, 1968, and died on November 7, 1969.
B. On August 28, 1950, the deceased participated in the Korean War, and was hospitalized in the First Camp Hospital on the same day, and discharged on March 20, 1951, the deceased was completely cured on and around 20, 1951 during the transition treatment to the 7th Army Hospital. 2) From September 3, 1958 to September 6, 1959, the deceased was promoted to the Second Lieutenant on June 1, 1958; from September 3, 1958 to September 6, 1959, from the 20g group of the Army from September 7, 1959 to January 29, 1960 to the 20g group of the Army from January 16, 1960 to the 193rd Military Hospital; from September 16, 1960 to the 193rd Military Hospital; from September 16, 1960 to the 195 Headquarters of the Army.
C. On October 24, 2005, the deceased’s wife I is the Defendant.
In the appellate court of Seoul High Court Decision 2008Nu23285 Decided April 25, 2009, the Plaintiff’s sibling, the inheritor, was appealed as Supreme Court Decision 2009Du1491 Decided December 10, 2009, on the ground that the deceased’s application for registration of bereaved family members of a person who has rendered distinguished service to the State was filed on the grounds of his/her right chest ordinary prize, high blood pressure outbreak, snow cancer outbreak, and snow cancer death, and thus, the deceased’s application for registration of bereaved family members of a person who has rendered distinguished service to the State was rejected. The Plaintiff’s sibling, the inheritor, was appealed as the Supreme Court Decision 2009Du14491 on December 10, 209.
On December 28, 2009, the Plaintiff is against the Defendant.
A person who has rendered distinguished services to the State shall file an application for registration of bereaved families of persons who have rendered distinguished services to the State, along with additional data, such as a beds site, a certificate of sick persons on duty, and a medical record site, and on March 5, 2010.
