The appeal is dismissed.

The grounds of appeal are examined.

In light of the relevant legal principles and evidence, the lower judgment convicting the Defendant of the instant facts charged on the grounds stated in its reasoning did not err by misapprehending the legal doctrine regarding the preparation of a private document for qualification, the preparation of a justifiable act, and the constructive acceptance, or by violating the principle of prohibition of analogical interpretation from the legal principle of a crime committed.

In addition, the argument that the court below erred in the misapprehension of legal principles as to private documents, which are the objects of the crime of preparing private documents for qualification, is not a legitimate ground for appeal, since the defendant's ground for appeal or the court below's decision was not subject to judgment ex officio.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
