Punishment of the crime

"2017 High Doz. 1456"

1. The Defendant, on February 5, 2016, found one copy of the card lost by the victim C within the annual subway station located in the five-dong Soksan city of Busan, Busan, on February 5, 2016.

Defendant 1 did not follow necessary procedures, such as returning the cards acquired as above to the nearest police station or the victim, and embezzled the cards for the purpose of unlawful use.

2. On February 5, 2016, around 19:59, the Defendant: (a) obtained a new card with the victim’s name acquired in accordance with paragraph (1) from the Busan Metropolitan City Franchising Co., Ltd.; (b) obtained a face-to-face amounting to KRW 1,000 as if he/she had completed the said card and could settle the account normally; and (c) obtained financial benefits, such as receiving approximately KRW 128,850, in total, 18 times as shown in the list of crimes committed by the Defendant.

3. On February 6, 2016, the Defendant, who attempted to commit fraud, presented a card obtained by using a new card in the victim’s name, such as paragraph 1, in G cafeteria located in Busan Metropolitan Government F on February 6, 2016, as if he/she were able to settle the account normally.

However, G employees requested approval using a card device with an food cost of KRW 80,000, but the former card victim failed to make a normal payment due to the loss report and refused approval.

4. The Defendant violated the Act on Specialized Credit Financial Business was unlawfully used in settling 128,850 won, such as the purchase name of tobacco, on 18 occasions, as stated in paragraph 2, with credit cards acquired at the time and place under paragraph 1.
