1. The Defendant shall pay to the Plaintiff KRW 76,846,378 and the interest rate of KRW 15% per annum from May 2, 2019 to the date of complete payment.
Reasons
In light of the overall purport of the arguments in Gap evidence Nos. 1 through 3, 5, 7, and 10, the plaintiff, on May 24, 2017, leased the part of "A" (hereinafter referred to as "the store in this case") which connects the defendant with each point of the items of the attached drawings Nos. 1, 3, 4, 6, 6, and 1 among the buildings listed in the attached Table No. 1 in the attached Table No. 1 in the attached Table No. 1 in order to the defendant on May 24, 2017, as the lease deposit amount of KRW 40,670,00, monthly rent of KRW 4,067,00 (excluding value-added tax), management fee of KRW 1,47,64, and value-added tax (excluding value-added tax), separate lease period of KRW 1,47,644 (the defendant's object at the expiration of the lease period) to the plaintiff on May 23, 2019.
According to the above facts of recognition, the Defendant is obligated to pay to the Plaintiff damages for delay calculated at the rate of 15% per annum from May 2, 2019 to the day of complete payment, which is the day following the day of delivery of a copy of the preparatory document dated April 29, 2019, which includes the Plaintiff’s expression of the above claim for payment.
Thus, the plaintiff's claim of this case is legitimate, and it is decided to accept it.
