Defendant shall be punished by a fine of KRW 1,500,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

The Defendant was a representative C in the second floor of the building in the Nam-gu Incheon Metropolitan City, who was a full-time employee and operated a private teaching institute.

1. When a worker dies or retires, the employer shall pay the wages, compensations, and other money or valuables within 14 days after the cause for such payment occurred;

Provided, That in special circumstances, the date may be extended by mutual agreement between the parties.

Nevertheless, the Defendant did not pay 4,15,190 won, including D’s wage 1,353,80 won in November 30, 2013, which worked from October 12, 2012 to November 30, 2013 at the above workplace, within 14 days from the date of retirement without agreement on extension of the due date between the parties.

2. When a worker retires, the employer shall pay the wages, compensations, and all other money and valuables within fourteen days after the cause for such payment occurred;

Provided, That the date of payment may be extended by an agreement between the parties in special circumstances.

Nevertheless, the Defendant did not pay the total amount of KRW 8,431,760 for three retired workers within 14 days from the date of retirement, as stated in the attached Table, as well as KRW 1,444,610 of D retirement allowances, which worked in the above workplace from October 12, 2012 to November 30, 2013, as well as KRW 8,431,760, as stated in the attached Table.
