A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

No person, other than an entrusted business entity, who is a national sports promotion corporation or an entrusted business entity of the Seoul Olympic Winter Games shall provide property or property benefits to persons who win the results of sports promotion by issuing voting rights or things similar thereto, and no person shall establish a gambling place for profit.

Nevertheless, the Defendant conspired with C, D, E, F, G, H, I, etc. (hereinafter “C, etc.”) in a successive manner to operate a private sports climate site; D is in charge of establishing and operating the site; C is in charge of investment and management of funds; C is in charge of managing members and the total number of members; J is in charge of supplying and managing large-scale passbooks; G is in charge of managing Chinese office; H is in charge of managing the Chinese office; H is in charge of managing the total number and members management, distribution rate adjustment, loyalty and exchange; H is in charge of withdrawing and delivering criminal proceeds to the Republic of Korea; and the Defendant, M, N, andO is in charge of the registration, dividends, management, etc. of the game, distribution, and members; and H is in charge of exchanging and exchanging the amount of money in the Chinese office; H is in charge of managing the Chinese office; and H is in charge of managing the Chinese office in the Chinese office.

According to such a public offering, the Defendant opened and operated “P” (the name of the site and the domain address from time to time) which is a private sports soil and entertainment site using a foreign server at the office located in the Cheongdo from April 2016 to March 29, 2017, when he/she posted the dividend rate for the sports games and the games, such as a domestic and foreign axis, camping district, and farming district, on the above site, and then deposits money to the account designated by the members of the above site, he/she filled up cyber money used in the betting, and let the members of the above site betting money, and paid the dividend that applies the dividend rate to the betting money to the members who met the result of the games.
