A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

"2015 Highest 2323" means that the defendant puts a false letter of sale to sell goods on the Internet goods trading site and receives money from the purchaser to acquire money.

On May 31, 2015, the Defendant posted a false statement on the Internet NAVV and the Internet bulletin board of the Republic of Korea, stating that “I will sell 70,000 won to the national bank account (D).” The Defendant received KRW 70,000 from the injured party on May 31, 2015, using the same method as indicated in [Attachment 1] crime list, and received KRW 2,676,900 from the day of September 13, 2015 to the said account under the name of the game machine payment from the injured party.

On October 30, 2015, the Defendant posted a false letter stating that “The sale of a bank is made” on the Internet site in the BPC room near the Gansung University located in Busan Metropolitan City, and that “the sending of a bank to B if it is sent KRW 130,000,000.”

However, the defendant did not have any intention or ability to send a bank even if he receives money from the injured party because he did not have a bank.

Defendant deceiving the victim as above and transferred KRW 130,000 on the same day from the victim to the Busan Bank account in the name of the Defendant, and from that time until February 15, 2016, the victims were deceiving the victims by the same method 44 times, such as the list of crimes in the attached Table 2 from February 15, 2016, and received total KRW 4,506,000 from the victims.

Accordingly, the defendant was informed of the victims to receive property.

1. On December 4, 2015, the Defendant was at the time of influence of the trade name of the wife of the Sungsung-dong University located in Nam-gu Busan, Busan.
