This part of the defendant's assertion of mistake is not accepted.

(2) The purpose of Article 14(1) of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes is to punish the act of photographing another person’s body, which may cause sexual humiliation or sense of shame by using camera-use photographing parts (A) camera or other similar devices, to protect the victim’s sexual freedom and freedom not to be taken without permission.

Whether the photographing body constitutes “the body of another person who may cause sexual humiliation or shame” is objectively the same as that of the victim.
