1. Revocation of a judgment of the first instance;

2. The defendant on February 27, 2005, as to the 188 square meters of the B ditch at the time of racing to the plaintiff.

1. On February 14, 1931, 1931, the Ansan River Repair Cooperative, the Plaintiff’s assertion for the transfer of the Plaintiff, purchased B ditch 188 square meters (hereinafter “instant ditch”) from E and thereafter thereafter since the completion of the registration of transfer of ownership on October 7, 1931, the Plaintiff occupied the instant ditch until then. The Defendant acquired the instant ditch by prescription on February 27, 2005, when 20 years elapsed from February 27, 1985, when the registration of transfer of ownership was completed.

Therefore, the Defendant is obligated to implement the registration procedure for transfer of ownership on February 27, 2005 with respect to the ditch of this case to the Plaintiff.

2. Determination as to the cause of action

A. The facts of recognition 1) An Ansan River Construction Association was established on July 3, 1928 and changed the name of the Ansan River Land Improvement Association (A. 21, 1962), the Ansan River Improvement Association (A. 21, 1970), the monthly farmland Improvement Association (A. 9, 1973), and the racing farmland Improvement Association (C. 1, 1989). According to the Korea Agricultural and Rural Infrastructure Corporation and Farmland Management Fund Act, the name was changed into the Korea Agricultural and Rural Corporation and the Korea Rural Community Corporation and the Korea Rural Community Corporation and the Korea Rural Community Corporation under the Korea Agricultural and Rural Community Corporation and Farmland Management Fund Act, the name of G was changed to the Korea Rural Community Corporation and the Korea Rural Community Corporation under the Korea Rural Community Corporation and Farmland Management Fund Act; 2) on October 31, 1911, and the above land was divided into the size of 1,298.6 square meters before C. 95 square meters before April 5, 1913.

C The previous 959 square meters was divided into 509 square meters prior to C on September 1, 1931, B, 188 square meters prior to H, and 261 square meters prior to H on September 1, 193, and the previous 188 square meters was converted from the previous 1931 to the ditch.

(3) On February 14, 1931, the Plaintiff purchased the ditch of this case from E where the owner of the ditch of this case was the owner, and completed the registration of ownership transfer on October 7, 1931. Since that time, the Plaintiff occupied the ditch of this case by using it as water for sale. 4) At the present real estate register as to the ditch of this case, the Defendant stated that the registration of ownership transfer was completed on February 27, 1985 due to sale as of February 25, 1985.
