1. Basic facts

A. According to the Land Survey Book drawn up during the Japanese occupation period of land assessment title and the current status of the land, C, which has the domicile in the field of Pakistan-gun, Gyeonggi-do, is indicated as having received the assessment of 181 square meters (hereinafter “instant assessment land”) prior to D, Pakistan-gun, 1913, June 1, 1913.

Gyeonggi-do Pakistan-gun is divided into F and G around 1895, and part of F, G and H were integrated into E around 1914.

At that time, part of I, B, and J were integrated into K, and the designation is currently L at the time of strike.

On April 27, 2005, M 123 square meters was divided from the land of the instant assessment.

B. The registration of preservation of ownership in the name of Defendant Republic of Korea and the registration of preservation of ownership in the name of Defendant Gyeonggi-do was completed on August 21, 1996 on the land of this case, by the receipt of the registration office of the senior branch court of the District Court of Dongyang-do, the registration of preservation of ownership was completed.

Since then, the Defendant Republic of Korea consulted with the Defendant Gyeonggi-do on the acquisition of a public site with respect to the land of 123 square meters (hereinafter referred to as “land indicated in paragraph (2) of the attached Table”) prior to M in the case of strike, which was divided from the land of this case, and on November 11, 2010, the registration of ownership transfer was completed to the Defendant Gyeonggi-do as the receipt of the same registry office.

C. C, who is the title of inheritance-related land assessment, died, and N, his son, solely succeeded to C, and N on February 4, 1951, as N died, P, Q, Plaintiff, and R were jointly succeeded to N on April 23, 1991. The N died on April 23, 1991.

2. The assertion and judgment

A.
