A defendant shall be punished by imprisonment for four months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

피고인은 2015. 1. 9. 20:40경 강릉시 C에 있는 ‘D주점’에서 주취소란자가 있다는 내용의 112신고를 받고 현장에 출동한 강릉경찰서 E지구대 소속 경사 F, 경사 G가 현장에 도착하여 술에 취해 난동을 소주병 등을 바닥에 집어 던지며 욕설을 하고 있는 피고인을 제지하면서 진정시키려고 하자, “씨발놈”이라고 욕설을 하면서 위 경찰관들의 멱살을 순차적으로 잡아 흔들어 위 F이 입고 있는 경찰 외근 상의 조끼 지퍼가 뜯어지게 하고, 피고인의 머리로 위 F의 얼굴을 들이 받을 듯한 행동을 하며 위 F을 위협하고, 발로 위 F의 정강이를 수회 걷어찼다.

Accordingly, the defendant interfered with the legitimate execution of duties of police officers concerning the handling of 112 reported cases.
